A residential apartment is located in a residential building within a municipality known for its vibrant community and scenic views. The property is currently leased to a third party, who may have a preferential right to purchase it. The property will be transferred in its entirety and as it stands, including its current registrational and cadastral status, as well as its physical state, quality, legal status, urban planning compliance, administrative standing, licensure, protection, conservation, and cleanliness. The seller will ensure that all expenses and taxes required by law are up to date at the time of sale.
The purchaser will accept the property in its existing condition, taking on the responsibility for the physical state of the property, urban planning realities, and any discrepancies that may exist between the actual physical dimensions and those recorded in legal documentation. The property will not guarantee the following: the financial reliability of the tenant, the terms of the lease agreement, its condition of conservation, any visible or apparent defects, the regularization of its registrational or cadastral status, or any variations in the property's dimensions that may be present. Additionally, the property will not be responsible for obtaining the certificate of habitability unless required by local legislation. Any costs arising from these situations, including attorney fees, will be the responsibility of the buyer.
If the property owner has initiated legal proceedings against the tenant at the time of sale, the new owner may take over that litigation but cannot claim any compensation from the property owner, except for legal fees incurred up to the transfer date, which will be borne by the new owner. The sale price has been set considering these circumstances, which indicate a reduced value, and must be explicitly acknowledged by the buyer upon finalizing the property transfer.
